1. Overview

This website is operated by Dinner Sorted. Throughout these Terms, “Dinner Sorted,” “we,” “us” and “our” refer to the business operating this online store.

These Terms govern your use of our website and your purchase of meals, products and services from us. By visiting our website or placing an order, you agree to these Terms, together with our Refund Policy, Delivery Policy and Privacy Policy.

If you do not agree to these Terms, you should not use the website or place an order.

3. Eligibility

You must be legally capable of entering into a binding agreement to place an order. If you place an order for another person, you confirm that you have authority to provide their delivery and contact information and to accept these Terms on their behalf.

You may not use our website or products for any unlawful or unauthorised purpose.

4. Products and menu information

We make reasonable efforts to display our meals, ingredients, portions and other products accurately. Photographs are illustrative, and presentation may vary because meals are prepared by hand and ingredients may vary seasonally.

All products are subject to availability. If an ordered item is unavailable, we may contact you to agree on a suitable replacement, offer store credit with your agreement or issue a refund for the unavailable item.

We will not knowingly make a substitution that materially changes an identified allergen or dietary characteristic without informing you.

5. Allergies and dietary requirements

Our kitchen may handle common allergens, including nuts, peanuts, gluten, dairy, eggs, soya, sesame, fish and shellfish. Although reasonable care is taken, we cannot guarantee that every meal will be completely free from traces of allergens unless we expressly confirm this in writing.

Customers are responsible for reviewing available ingredient and allergen information and informing us of relevant allergies or dietary requirements before ordering.

Our meals and website content are not intended to provide medical or nutritional advice. Customers with serious allergies or medical dietary requirements should consult an appropriate healthcare professional before ordering.

6. Orders

Placing an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.

We may decline or cancel an order where:

  • a product is unavailable;

  • payment cannot be authorised;

  • pricing or product information contains an obvious error;

  • we cannot deliver to the supplied address;

  • the order appears fraudulent or unlawful; or

  • accepting it would breach applicable law.

If we cancel an order after payment has been received, we will refund the affected amount.

You are responsible for checking your order information, delivery address, contact number, dietary selections and requested delivery date before completing checkout.

7. Prices and payment

Prices are displayed in South African rand and include applicable taxes unless stated otherwise. Delivery charges and any other applicable fees will be shown before checkout is completed.

We may change prices at any time, but a change will not affect an order we have already accepted, except where the displayed price was clearly incorrect.

Payment must be completed using one of the payment methods offered at checkout. Payments may be processed by PayFast or another authorised third-party payment provider. Those providers process payment information according to their own terms and privacy practices.

We do not guarantee that every payment method will always be available.

8. Cancellations and refunds

Because our meals are freshly prepared and perishable, cancellation rights may be limited once ingredients have been sourced or preparation, fulfilment or delivery has begun.

Cancellations, incorrect orders, damaged meals and refunds are governed by our Refund Policy.

Nothing in these Terms limits any consumer right that cannot lawfully be limited under South African law.

9. Delivery

Delivery areas, charges, estimated times, customer responsibilities and unsuccessful deliveries are governed by our Delivery Policy.

You must provide an accurate delivery address, an active contact number and any access instructions needed to complete delivery.

To the extent required by applicable law, products remain at our risk until delivery has been accepted. Once delivered, you are responsible for promptly refrigerating, freezing, reheating or consuming meals according to the supplied instructions.

We are not responsible for deterioration caused by improper storage, handling or reheating after delivery.

10. Promotions and discount codes

Promotions and discount codes are subject to their stated conditions and validity periods. Unless expressly stated otherwise, they cannot be combined, exchanged for cash or applied retrospectively.

We may withdraw or correct a promotion where it contains an obvious error, has been misused or is affected by fraud, subject to applicable law.

11. Website use

You may use this website only for lawful personal or business-purchasing purposes. You may not:

  • interfere with the website’s security or operation;

  • introduce malicious code;

  • attempt to gain unauthorised access to any system or account;

  • use automated tools to scrape or copy website content without permission;

  • submit false, misleading or fraudulent information; or

  • use our content or intellectual property without authorisation.

We may restrict access where we reasonably believe these Terms have been breached.

12. Intellectual property

The Dinner Sorted name, logo, photographs, recipes, written content, graphics and website design are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify or commercially exploit this content without our prior written permission.

13. Third-party services and links

Our website may contain links to or integrations with third-party services. We are not responsible for third-party websites, content or services that we do not control.

Your use of a third-party service may be governed by that provider’s separate terms and privacy policy.

14. Privacy

We process personal information in accordance with our Privacy Policy and applicable South African data-protection law.

15. Liability

We do not exclude or limit liability where doing so would be unlawful. In particular, nothing in these Terms excludes rights or remedies arising from unsafe or defective goods, fraud, gross negligence, or any other liability that cannot lawfully be excluded.

To the fullest extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable when an order was placed.

16. Events beyond our reasonable control

We are not responsible for a delay or failure caused by events reasonably beyond our control, including severe weather, road closures, power or service interruptions, supplier failures, civil unrest or government restrictions.

Where such an event affects an order, we will contact you as soon as reasonably possible and attempt to arrange an alternative delivery, replacement or appropriate refund.

17. Changes to these Terms

We may update these Terms when our services, business practices or legal obligations change. The version published on our website at the time an order is placed will ordinarily apply to that order.

18. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the appropriate South African courts or consumer dispute-resolution body.

Nothing in this section prevents a consumer from exercising rights available under the Consumer Protection Act 68 of 2008 or other applicable law.
